Alternatives that Contractor contemplate
Many contractors contemplate hiring an “independent” contractor so as to avoid having to pay for workers compensaton insurance. If this is what you intend to do we highly recommend you seek legal advise and be aware of the consequenses of not following “Best Practices.”
Generally speaking, when hiring an independent contractor you should always require they carry the same limits of general liability, professional liability, workers compensation, commercial auto and are licensed to perform they type of work you are hiring them for.
Furthermore, you should require that you and your firm be named as additional insureds.
We are not done yet! You should always have a written hold harmless agreement as well.
Special endorsements are also a good idea. Two such endorsements are Waiver of Subrogation and Primary and non-contributory wording.
Also, when bidding a project, we always recommend you request to view the insurance requirements before releasing the bid. Allow your agent or broker time to review the insurance requirements for worker compensation as well as for other insurance items such as general liability, commercial auto and other items.
